1. Introduction

Welcome to D&D (“we,” “our,” “the App”)! We created this mobile application to provide a unique dating opportunity that combines social interaction and charity. D&D allows users to join shared leisure activities organized by other participants, subject to a charitable contribution. Our mission is not only to create new connections between people, but also to promote good deeds through every meeting.

These Terms and Conditions apply to our website https://datedonate.app/ in full, including all our subpages, related sites or pages (the “Website”), as well as the Android and iOS mobile application “D&D” (the “Mobile Application”), and the related services and features (for simplicity, all of this together with the Website and the Mobile Application we call the “Services” in these Terms and Conditions) (collectively, “D&D”). We have also added links to these Terms and Conditions across all relevant services. Some services may require their own unique Terms and Conditions. If a particular service has its own Terms and Conditions, then the Terms and Conditions of that service apply, not these Terms and Conditions.

These Terms and Conditions (“Terms”) govern your access to and use of the D&D mobile application.
All references to “D&D” in this document are interchangeable and refer to the same service.

By using the service (the App), you agree to these Terms and Conditions (“Terms” or the “Agreement”), including our Privacy Policy (including the use of cookies), so it is important to carefully review this Agreement as well as the specified policies and procedures before creating an account.

If you do not agree with any provision of these Terms, you are not entitled to use the service and must immediately stop using it.

We reserve the right to change, update, or revise these Terms at any time. All updates take effect upon their publication in the App. We recommend checking this page regularly to stay informed about the latest changes. By continuing to use the service after the Terms are updated, you confirm your agreement with the changes made.

Our service is intended for adult users (18+), and by registering in the App, you confirm that you meet this requirement. Use of D&D is voluntary, and we do not guarantee that every user will find a partner or be satisfied with the results of dating.

We strive to provide a safe and comfortable environment for all users, so we encourage adherence to the principles of mutual respect and ethics when interacting with other platform participants. In case of questions or disputes, you can contact our support service using the contact details provided.

2. General Provisions

These Terms and Conditions are a contract between you and Driveforce Ltd (company number: 207576513, company registration date: 27.10.2023; address: Odrin St., 15, 9th floor, 8001 Northern Industrial Zone, Burgas, Bulgaria).

Please read these Terms before you begin using the App. From the moment you access, view, or use the App, you accept these Terms and are legally bound to comply with them (so it’s probably best to read them first!). We also recommend reviewing the Community Guidelines, which are an integral part of these Terms, as well as our Privacy Policy.

D&D grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with the terms of this Agreement.

You acknowledge and agree that the availability of D&D and its software depends on third-party services through which you obtain the D&D App (for example, Google Play, Apple App Store, or HUAWEI AppGallery (hereinafter, the “Distribution Platform”)). You acknowledge that this Agreement is concluded directly between you and us, and not with the respective Distribution Platform.

Each Distribution Platform may have its own terms of use and rules that you must read and agree to before installing, accessing, or using D&D.

The terms “us,” “we,” “the Company,” and/or “D&D,” “D&D” refer to Driveforce Ltd. You and D&D together may be referred to as the “Parties” or individually as a “Party.”

The terms “D&D,”  “we,” “the Company,” and “our,” as used in this Agreement, depending on the context, refer to Driveforce Ltd. You and D&D together may be referred to as the “Parties” or individually as a “Party.”

By downloading D&D software or accessing or using our Services on the website datedonate.app (the “Website”), in the D&D mobile application (the “App”), or through any other platforms or services that D&D may offer (collectively, the “Service” or our “Services”), you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

These Terms apply to all persons who access or use our Services, regardless of registration status or subscription.

Under no circumstances shall the D&D team be liable for any direct, indirect, special, incidental, or consequential damages, including but not limited to loss of data or profits, arising in connection with the use of or inability to use the materials on this service, even if the D&D team or its authorized representative has been advised of the possibility of such damages.

D&D is not responsible for any consequences that may arise in the process of using our resources. We reserve the right to change prices and revise the resource usage policy at any time.

By using this service, you agree to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use the D&D Service. In these Terms and Conditions, the term “you” refers both to you personally and to the organization you represent.

If you violate any of these Terms and Conditions, we reserve the right to cancel (delete) your account or block access to it without prior notice.

3. DEFINITIONS

For proper understanding of these Terms, the terms below have the following meanings:

  • User – any person who has registered or uses the D&D mobile application regardless of role (Organizer or Participant). The User agrees to the terms of use of the service and complies with the established rules.
  • Organizer – a user who creates an invitation to a shared leisure activity, independently determines its conditions and the fund for the charitable contribution. \
  • Participant – a user who confirms participation in shared leisure, agreeing to the conditions determined by the Organizer, and makes the corresponding payment using the App’s functionality. The Participant has the right to choose the organizer, view available offers, and pay for shared leisure in accordance with the established rules and the service policy.
  • Charity – the amount allocated from each buyer’s payment and transferred to support charitable organizations. Users can view the list of organizations that receive funding in the relevant section of the App.
  • Content – any materials posted by users in the App, including text descriptions, photos, videos, reviews, messages, etc. Content must comply with the service rules and must not infringe the rights of others.
  • Service – the functional capabilities available to users in the D&D App, including viewing profiles, selecting the type of shared leisure, making payments, communication between users, rating meetings, and other interactive options.
  • Account – the user’s personal page containing their data, profile settings, payment history, active date offers, and other information necessary to use the service.
  • Service Administration – the team of moderators and technical specialists of D&D responsible for ensuring the proper functioning of the App, resolving disputes, ensuring user safety, and monitoring compliance with the service rules.
  • Prohibited Content – any materials that are contrary to the law, contain offensive, aggressive, sexually explicit, discriminatory information, or otherwise violate the service rules and may be removed by the administration without prior notice.
  • Prohibited Actions – any actions by users that violate the service rules, including fraud, violations of communication ethics, creation of fake accounts, use of the App for illegal purposes, defamation, harassment, distribution of personal information without consent, and other violations.
  • • Cookies: a small amount of data created by a website and stored by your web browser. Used to identify your browser, provide analytics, remember information about you such as language settings or login data.
  • Company: when these Terms mention “the Company,” “we,” “us,” or “our,” this refers to Driveforce Ltd (Odrin St., 15, 9th floor, 8001 Northern Industrial Zone, Burgas, Bulgaria), which is responsible for your information under these Terms and Conditions.
  • Device: any internet-connected device such as a phone, tablet, computer, or any other device that can be used to visit D&D and use its services.
  • Service: means the service provided by D&D as described in the relevant terms (if any) and on this platform.
  • Third-Party Service: refers to any services, platforms, applications, websites, or other digital or offline resources not owned or controlled by D&D but that may interact with our service or be used in its operation (payment systems, verification and moderation services, mapping services, advertising and marketing partners, analytics services, app distribution platforms, etc.).
  • App/Program: the D&D mobile application identified as the SOFTWARE PRODUCT mentioned above.
  • You: a natural or legal person who has downloaded D&D software or accessed or used our Services on the website datedonate.app (the “Website”), in the D&D mobile application (the “App”), or through any other platforms or services that D&D may offer to use the Service.

All terms listed in this section are used in these Terms with the meanings indicated. Unless otherwise stated in context, they are interpreted according to the definitions provided above.

4. REGISTRATION AND ACCOUNT

4.1. Age and Eligibility

Registration and use of the D&D service are available only to persons who are 18 years of age or older. Use of the platform by minors is strictly prohibited.

By registering in the mobile application, the user confirms that they are at least 18 years old and assumes responsibility for the accuracy of this information. If a violation is detected, the account may be deleted immediately without refund.

4.2. Creating an Account

To use D&D, the user must create an account by providing truthful, current, and complete personal data.

The registration process may require email verification or login via third-party services (Google, Apple ID, etc.).

The user undertakes not to create more than one account. Using multiple accounts to deceive or circumvent restrictions is a violation of the rules and may result in all accounts being blocked.

4.3. Account Security

The user is fully responsible for the security of their account and the confidentiality of their registration data (login, password, login data through third-party services).

Sharing account data with third parties is prohibited.

You agree to immediately notify D&D support if you detect any suspicious activity in your account, lose control of your account, detect unauthorized access, or suspect a breach. To do this, use the built-in “Feedback and Suggestions” form in the App or send a message to our email address dateanddonate@proton.me. We recommend that you change your password regularly, especially after any suspicious incidents.

D&D is not responsible for any actions taken by third parties on behalf of the user in the event of compromise of their credentials.

4.4. Authentication and Photo Verification

To create an invitation for shared leisure for a donation, the Organizer must pass photo verification. This is necessary to confirm their identity and the consistency of the uploaded photos. Only after successfully passing photo verification does the user gain the ability to appear in the feed.

Photo verification is carried out using the Amazon Rekognition API and is also checked manually by moderators.

Without identity confirmation, the user will not be able to create shared leisure or participate in the service.

The user agrees that their face may be verified using biometric technologies of a third-party service (Amazon Rekognition), and they consent to the transfer of photos to verify the authenticity of the image.

4.5. Editing and Updating the Profile

The user can change information in their profile, including photos, description, preference settings, etc.

It is forbidden to provide misleading or false information. If such violations are detected, D&D reserves the right to block or delete the account.

4.6. Deleting and Blocking the Account

The user can delete their account at any time through the profile settings.

In the event of violations of the Terms and Conditions, fraudulent actions, breaches of communication ethics, or use of the platform for improper purposes, the account may be blocked or deleted by the administration without prior notice.

5. MODERATION AND PROFILE VERIFICATION

Moderation and profile verification are key elements of safety and trust in D&D. We strive to create an environment in which users can be confident they are communicating with real people, as well as to protect the platform from fraud, fake accounts, and unacceptable content. This section describes how profile verification is conducted, what photo and content requirements apply, and what happens in the event of violations of the service rules.

5.1. Purpose of Moderation

Moderation and profile verification in D&D aim to ensure user safety by verifying the authenticity of personal data and photos; preventing fraud, creation of fake accounts, and violations of platform rules; building trust among service users; and creating a comfortable environment for dating, where profiles correspond to real people.

5.2. Photo Verification and Profile Confirmation

Photo verification is mandatory for all users who wish to organize (create in the service) shared leisure for a donation and appear in the feed. Amazon Rekognition API is used for verification, which performs automatic photo analysis. After automatic verification, moderators manually compare the selfie (authentication) with the photos in the profile. If photo verification is successfully passed, the user receives a mark of verified profile photos, which is displayed on the profile.

If the moderator detects inconsistencies or suspicious activity, the user may be asked to undergo additional verification or be refused confirmation.

5.3. Control of User Content

It is forbidden to upload to the profile or during photo verification:

  • photos that do not belong to the user;
  • images of celebrities, cartoon or artificially created characters;
  • photos with improper or unacceptable content (nudity, violence, drugs, etc.);
  • images with texts, logos, or watermarks that may mislead.

In case of violation of these rules, the photo may be rejected by moderators, and the user may be temporarily or permanently blocked. The administration reserves the right to request additional confirmation of identity authenticity.

5.4. Prevention of Fraud and Fake Accounts

To combat malicious actors and fake accounts, D&D uses automatic algorithms to detect suspicious accounts and checks repeated attempts to register after blocking. We have implemented mandatory moderation following user complaints.

If you use bots or automated services to interact with the platform, we will block such accounts.

The user agrees that their face may be verified using biometric technologies of a third-party service (Amazon Rekognition), and they give consent to transfer their photos solely for the purpose of verifying image authenticity in accordance with the Privacy Policy.

5.5. Complaints and Violations

Users can report a suspicious profile or content using the “Report” function in the App.

All complaints are reviewed by moderators, who may remove content or restrict access to the profile.

In case of repeated violations, the administration has the right to permanently block the account.

5.6. Verified Profile Badge

Users who have successfully passed photo verification and moderation receive a special badge in their profile. This allows other participants to see that the profile is verified and the user is a real person.

6. Use of the Service

The D&D service was created to ensure a safe, responsible, and enjoyable dating experience. This section regulates the rules for using the App and contains restrictions introduced to prevent abuse, fraud, and infringements of other users’ rights.

Please read these conditions before you start using the platform. Violations of the rules of this section may lead to restriction or blocking of access to the service.

6.1. Purpose of the Platform

D&D is a mobile dating application that combines social interaction with elements of charity. The service provides the opportunity to organize and participate in shared leisure for a donation, communicate between users, and participate in initiatives related to charitable activities. We are not a dating agency, do not guarantee success in relationships, or any results in communication between users.

Shared leisure activities offered in D&D are social or friendly in nature and are not the subject of commercial exchange or intimate services.
An offer to participate in shared leisure is not the sale of a date. It is a voluntary user initiative that allows them to propose the time, place, and purpose of the meeting.

Shared leisure is exclusively a physical service that takes place outside the App. Users are solely responsible for organizing, honoring agreements, and ensuring safety during such meetings.

Since all shared leisure takes place outside the App, users are fully responsible for:

  • organizing, confirming, and holding the meeting and shared leisure, including choosing a safe place;
  • adhering to ethical and legal norms during the meeting;
  • safety during physical contact with other users.

The D&D platform solely facilitates the organization of social, cultural, or friendly meetings. We do not interfere with the content or development of relationships between users after shared leisure, and the service itself does not profit from the outcome of such interaction.

6.2. User Conduct

You agree to use the service exclusively for lawful purposes and in compliance with ethical rules. It is forbidden to:

  • impersonate another person, including using someone else’s photos or false personal data;
  • distribute offensive, vulgar, discriminatory, aggressive, or sexually explicit content;
  • coerce actions of a sexual or other nature, including through psychological pressure or manipulation;
  • post commercial advertising or promote third-party services not related to D&D’s functionality;
  • infringe the intellectual property rights of other users or third parties.

6.3. Prohibited Use

It is forbidden to use the service for the following actions:

  • any form of direct or indirect bullying, humiliation, insults, intimidation, or threats to other users;
  • psychological pressure, manipulation, coercion, or any other forms of violence directed at other users;
  • sending threats of physical, psychological, or other violence, or messages that may be perceived as threatening, aggressive, or offensive;
  • any attempts to manipulate other users in order to obtain financial or other benefits;
  • for intimate meetings, escort, procuring, prostitution, pimping, or any form of sexual services for remuneration;
  • for fraudulent actions or attempts to obtain money/services by deceit;
  • for posting spam, phishing, malware, or links to third-party resources;
  • for creating fake accounts, bots, or using automated means to interact with the App;
  • for creating multiple accounts by one person to circumvent rules or a ban.

Violation of any of the above points may result in temporary restriction of functions, account blocking without warning, or transfer of data to law enforcement authorities if required by applicable law.

6.4. Territorial Restrictions

Some features or services may be unavailable in certain countries or regions due to legal restrictions or technical reasons.

We reserve the right to restrict or terminate access to the service in jurisdictions where the use of D&D contradicts the law.

6.5. User Responsibility

You bear full responsibility for your behavior in the App, including the content you upload, the messages you send, and the shared leisure activities you create or attend.

You agree not to take actions that may harm the reputation, security, or technical stability of the service.

You acknowledge that communication and shared leisure take place at your own risk, and D&D is not responsible for the actions of other users outside the App.

6.6. Reporting Violations

Each user has the ability to complain about another profile or content using the “Report” function.

The administration reserves the right to conduct investigations, limit account functions, or block access upon detecting violations.

7. PAYMENT AND FINANCIAL ASPECTS

The D&D service combines dating and charity. The full payment for participating in shared leisure is directed to good causes—you can choose the fund you want to support. This section regulates the payment procedure, the conditions for transferring funds, and the financial responsibilities of the parties.

7.1. Participation model

The user who creates an invitation to shared leisure (the Organizer) determines the format of the event and may choose a charitable fund to which the donation will be made.
Another user (the Participant) can join the shared leisure by making a charitable contribution through the payment system. The entire contribution is directed to charity.

We use third-party payment services to carry out financial transactions. All payments are made in a currency supported by the service and the respective payment partner.

Payment is made exclusively for the possibility of participating in shared leisure, not for the outcome or content of such a meeting. We do not guarantee any result of the interaction between users.

7.2. Contribution distribution structure

The total amount paid by the Participant is distributed as follows.
All funds paid by the Participant as part of participation in shared leisure are credited as charitable donations.
The Organizer does not receive any financial reward.

7.3. Holding funds (reservation)

After payment is confirmed, the funds are not debited immediately but are reserved (held) by the payment provider until the shared leisure is completed.
Unblocking and distribution of funds occur only after the shared leisure has taken place (automatic confirmation or confirmation by the participant via the app).
In case of cancellation of participation in shared leisure under the rules provided in Section 8, the funds are returned to the Participant or redistributed in accordance with the service’s policy.

7.3.1. D&D service fee

The D&D service does not charge any fees from users. All contributions made by participants during shared leisure are transferred in full to the selected charitable fund.

7.3.2. Overall payment structure

The total amount that the Participant sees and pays consists exclusively of the charitable contribution, which is transferred to the fund selected within the app.
No reward for the Organizer is provided.

7.3.3. Transaction transparency

Before confirming payment, the Participant is shown the full structure of the payment with the amount of the charitable contribution. The Organizer sees only the donation amount.

7.3.4. No commission deducted from charity

D&D does not withhold a commission from the charitable contribution. All funds that are designated (determined by the user who creates the invitation to shared leisure) as charity are transferred in full to the selected fund.

7.4. Charitable component

The user has the option to choose one of the charitable funds, the list of which is provided inside the app.
All charitable transfers are made exclusively on transparent terms and can be checked in the user’s transaction history.
Part of the reporting on transferred funds may be available on the D&D website or YouTube channel.

7.5. Currency and taxes

All amounts are indicated in the currency chosen according to the user’s jurisdiction or the settings of the payment system.
The user bears full responsibility for fulfilling tax obligations in their country if this relates to receiving income through the service.
We reserve the right to issue financial information about transactions at the request of the user or supervisory authorities.

7.6. Refund policy

Refunds are possible only in the cases provided by the service, in particular:

  • cancellation of shared leisure by the Organizer in advance;
  • inability to provide the service due to a technical error on the part of the platform.

Funds are not returned in cases where participation in shared leisure was confirmed and is considered completed by both parties. All refund decisions are made individually by the support service after considering the circumstances.
Funds are returned only in cases provided for by these Terms. Refund of part of the payment in the event of partial performance or a dispute is considered individually.

D&D strives to ensure a transparent, secure, and fair financial process for both parties. If you have questions regarding payment or refunds, please contact support through the “Help” section in the app or via the contact details provided.

 

8. THE PROCESS OF CREATING, CONFIRMING, AND CANCELING SHARED LEISURE

Shared leisure in D&D are physical services outside the app that include the opportunity to get to know each other, spend time, and at the same time support charity. To ensure honesty, transparency, and comfort for all participants, the meeting process is regulated by a number of automated rules and actions. This section explains how shared leisure is created, confirmed, and canceled on the platform.

8.1. Creating an invitation to shared leisure

An invitation to shared leisure is created by a user (the Organizer) who wants to propose a meeting via a special form indicating: country, city, venue, date, time, type of shared leisure, donation amount, and charitable fund.
A user who wants to invite to shared leisure must pass photo verification. Without this, creating shared leisure is impossible. After saving the created shared leisure, it appears in the “My Meetings” tab and becomes available to other users in the feed.
The recommended time for shared leisure is 1 hour. This is the default setting, but the duration may be longer by mutual will of the users.

Note: You may propose any format of shared leisure; however, D&D does not allow intimate services, escort, procuring, or prostitution.

8.2. Start and confirmation of shared leisure

One hour before the start of the shared leisure, a chat between the participants is activated.
Thirty hours before the start of the shared leisure and one hour before the start, the system sends reminders.
After the shared leisure starts, both participants receive a push notification with the question: “Did you find each other?”
If the user who purchased participation in the shared leisure confirms that the meeting took place—it is automatically considered to have taken place.
Only the participant who confirmed participation in the shared leisure has the right to confirm it. This is done to protect the payer.
If no one confirms that the meeting took place, or does not press the “no one came” button, or does not send a complaint that the meeting did not take place or a geolocation, the shared leisure is automatically considered to have taken place 15 minutes after the scheduled time.
If someone did not show up or there are doubts—be sure to press “Didn’t find each other” or contact support within the first minutes after the start of the meeting.

8.3. Actions in case of unconfirmed participation in shared leisure or a complaint

If the users (Organizer and Participant) did not find each other, the system asks them to send their geolocation. If only one party sends a geolocation or a complaint is received—the system automatically creates a ticket to the support service. In the case of a confirmed violation (for example, a user did not show up), the funds may be returned, and the violator’s profile may be restricted.
If both users (Organizer and Participant) press “Didn’t find each other” and do not respond to subsequent system messages—the shared leisure is automatically closed as one that did not take place, with a refund to the Participant, except for payment system fees (if applicable). Users may receive a warning or restricted access to the platform in case of systematic instances of ignoring meetings.

8.4. Cancellation of participation in shared leisure

A user may cancel participation in shared leisure no later than 24 hours before its start.
If the cancellation occurred within the allowed time—the funds are returned in accordance with the refund policy.
If the Participant did not appear (without canceling participation in shared leisure in advance)—the shared leisure is considered to have taken place, and the funds are distributed in the standard manner: transferred to the charitable organization.
In case of the Organizer’s no-show or abuse—the profile may be restricted or blocked.

 

9. PERSONAL ACCOUNT

Your personal account (hereinafter, the “profile”) in the D&D app allows you to manage information about yourself, account settings, view your balance, the history of charitable contributions, and interact with the support service. We recommend that you carefully review this section for the most comfortable use of the app.

You can freely change or update information in your profile at any time; however, responsibility for the accuracy and correctness of the data provided rests entirely with you.

Information in your profile is available for viewing by other app users and may include the following data:
• Name, age (required fields);
• Height and weight (optional);
• Hair and eye color (optional);
• Gender identity;
• Settings regarding who will be shown to you in the feed (e.g., men, women, non-binary people);
• Languages you speak;
• Information about features (inclusivity) and limitations;
• Additional facts about you (zodiac sign, bad habits, and more).

You agree to use only your own photos in the profile. It is forbidden to use photos of other persons without their consent, images of celebrities, photos that violate moral or legal norms, as well as images with explicit or hidden advertising purposes.

Your profile may contain up to six photos, which undergo mandatory verification in accordance with the “Moderation and Profile Verification” section of these Terms.

Your profile settings allow you to manage the following functions:
• Changing your email address, linking or unlinking social networks;
• Choosing the interface language and units of measurement;
• Managing the list of blocked users;
• Temporarily suspending profile activity (“pause”);
• Setting the privacy of your geolocation;
• Managing push notifications and email notifications;
• Contacting D&D support;
• Reviewing privacy policies and other legal documents.

Balance and charitable contributions
Your profile also displays your current balance in the app’s internal currency and the total amount of funds you have directed to charity thanks to using the D&D service.

Feedback and suggestions
In the “Feedback and Suggestions” section, you can leave your comment, review, or propose an idea to improve the app. We strive to carefully consider each of your messages and respond as promptly as possible.

Security of your account
You are fully responsible for the confidentiality and protection of access to your profile. If you suspect that third parties have gained access to your account, immediately contact our support service.
D&D is not responsible for the loss of access to your profile if this occurred due to your failure to follow security recommendations.

 

10. USER CONTENT

D&D gives you the ability to upload, publish, and share content within the platform. We strive to provide a comfortable, safe, and respectful environment for all our users, and therefore we ask you to act responsibly regarding the materials you publish or send to other users.

You are fully responsible for all content that you create, upload, publish, distribute, or otherwise transmit through the D&D app. By uploading content, you warrant that you have all necessary rights to use it and that you do not violate the rights of third parties, including copyrights, privacy rights, confidentiality, and any other legal norms.

10.1. What content is allowed to upload

You may upload:
• Your own photos that clearly identify you as a real person.
• Information about yourself (profile description) that corresponds to reality and does not mislead other users.
• Messages to other users that comply with ethics and do not violate the D&D Community Guidelines.

10.2. What content is prohibited?

You are prohibited from uploading, sending, or publishing content that includes:
• Pornography, explicit or sexual images or materials.
• Content that implies intimate services, escort, prostitution, procuring, or other illegal or unethical activities.
• Photos of minors or persons who appear to be minors if such photos are presented in an unacceptable context.
• Photos of other people uploaded without their consent.
• Images of celebrities, animated characters, or other non-real images.
• Content containing hate, aggression, racism, xenophobia, discrimination, bullying, intimidation, or offensive language towards any person or group of people.
• Graphic scenes of violence, self-harm, or suicidal materials.
• Materials that advertise or promote drugs, illegal substances, or illegal actions.
• Content that infringes copyrights, intellectual property, or third-party trademarks.
• Photos, videos, or other materials containing personal or confidential information of other people without their consent (e.g., passport data, addresses, phone numbers, etc.).
• Advertising materials or spam, including links to other apps, sites, products, or services.

10.3. D&D’s rights to your content

By uploading any content to the D&D platform, you retain all copyrights to it. At the same time, you grant us a free, non-exclusive, worldwide, transferable, sublicensable license to use, copy, modify, display, reproduce, adapt, edit, and distribute your content within the platform and for D&D advertising or marketing purposes (for example, to show example profiles in service advertising). This license is valid as long as your content remains uploaded to the platform and may be revoked by you at any time by deleting such content, except in cases where the content has already been used in advertising materials before the time you deleted it.

10.4. Removal of unacceptable content

The D&D administration has the right at any time to delete your content if we consider that it violates these Terms, the Community Guidelines, moral standards, or applicable law. We may also restrict, suspend, or permanently block your account in the case of repeated or serious violations.

10.5. Complaints about other users’ content

You can report unacceptable or suspicious content using the special “Report” button in the app or “Feedback and Suggestions.” All complaints are considered by our moderators. We reserve the right to delete or block content that does not comply with the established rules.

10.6. Your responsibility for content

D&D is not responsible for user content. You are solely responsible for any consequences related to the use of content that you uploaded or sent through the platform. If any legal conflict or third-party claims arise due to your content, you agree to take responsibility for resolving such conflicts and to compensate D&D for any related damages.

10.7. Content moderation

To ensure compliance with these Terms, as well as Apple App Store and Google Play rules, D&D uses both automated tools and manual moderation to check content uploaded by users.
Moderation covers all materials that the user uploads, publishes, or sends within the platform, including: profile photos; profile description; chat messages; comments; photos and videos during photo verification.

Any content you upload may be checked before or after publication by automated systems (including artificial intelligence) and human moderators who review content in accordance with the Terms, Community Guidelines, legislation, and Apple/Google policies.

We may refuse publication, remove, modify, or restrict access to any content without notice if: it violates the service Terms, platform standards, or legislation; has an unacceptable, offensive, unethical, or illegal character; contains elements of copyright infringement or fraud; creates risks to user or platform security.

We may take measures against a user who systematically or grossly violates content requirements—including limiting functions, temporary blocking, or complete deletion of the account.

If your content has been blocked, hidden, or deleted, you will receive an automatic notification in the app or by email stating the reason for moderation, if possible.

If you disagree with the moderator’s decision, you have the right to submit an appeal within 7 calendar days from the moment you receive the moderation notice.

To submit an appeal, use one of the following channels. The “Contact Support” function in the “Profile” > “Support” section. Write an email to dateanddonate@proton.me indicating: your login; a description of the situation; the reason you believe the moderator’s decision is erroneous; additional materials or explanations (if any).

The D&D administration will review your appeal within 5–10 business days. As a result, we may overturn or adjust the previous decision or leave the decision unchanged, explaining the reasons.

Users who abuse appeals (for example, massively challenging obvious violations or insulting moderators) may be restricted in the right to submit complaints.

10.8. Content in photo verification

Photos provided as part of photo verification are also considered user content. They must:
• Clearly identify the person in the photo.
• Not contain third parties, objects, or elements that may mislead.
• Be taken in accordance with the validation system instructions (for example, with a specified facial expression or gesture).

Failure to comply with these requirements may result in photo verification being rejected, restriction of account functions, or blocking access to certain sections of the platform (for example, participation in the feed).

10.9. Use of Artificial Intelligence and Content Filtering

The Service may use artificial intelligence technologies to improve service quality, including recommendations, content moderation, and fraud detection. The user agrees to the use of such technologies within the limits defined by the Privacy Policy.

To maintain service quality, we may apply automated machine-learning models for the initial assessment of content. These models can:

  • Detect standard violations (for example, indecent images).
  • Add metadata to content for further processing by moderators.
  • Determine the need for manual review or automatically approve/reject content.

However, the final decision regarding the publication or blocking of content is always made by moderators, which ensures objectivity and the possibility of appeal in disputed situations.

10.10. Reporting and Cooperation with Law Enforcement

In cases where user content:

  • contains calls for violence, incitement of hatred, or other signs of criminal activity;
  • may indicate a threat to the life, health, or safety of individuals;

D&D reserves the right to cooperate with the relevant authorities, provide the necessary information upon receipt of a request in accordance with the law and/or report violations that may contain signs of a crime.

 

11. SECURITY AND LIABILITY

We recommend using common sense when dating and meeting (participating in shared leisure).
D&D is not responsible for users’ actions outside the app.

We strive to create a safe and comfortable environment for dating on D&D, but it is important to remember that real safety begins with the responsible behavior of each user. This section explains what responsibility we as a service assume, and what each user is responsible for when using the platform.

11.1. Your Personal Safety

You are fully responsible for your actions in the app, as well as for any shared leisure you organize or participate in through D&D.
Before agreeing to shared leisure, we recommend reviewing the other person’s profile, paying attention to the photo-verification badge, and using only safe places for meetings.

Recommended:

  • Arrange meetings only in public and well-lit places.
  • Inform family or friends about an upcoming shared-leisure participation.
  • Do not disclose personal or financial information (phone number, home address, banking details, etc.).

11.2. User Conduct

Every user must adhere to ethical standards when communicating and interacting on the platform.

Prohibited:

  • Stalking or harassing other users.
  • Using offensive, demeaning, or discriminatory language.
  • Attempting blackmail, psychological pressure, or forcing someone into a meeting.

We reserve the right to restrict access or block the profile of any user who violates the rules of communication or otherwise jeopardizes others’ safety.

11.3. In-Person Meetings and Off-Platform Interaction

D&D is not a party to agreements between users regarding shared leisure. We only provide a platform for creating and participating in shared leisure and facilitating introductions and communication.
We are not a service for escort or sexual services and do not offer sex for money or procuring.
We are not responsible for user behavior during real-life meetings, nor for any events or consequences that arise outside the service.

If you find yourself in a dangerous situation or encounter unacceptable behavior from another person, report it to support or use the “Report” function.

11.4. Safety Recommendations

Before your first participation in shared leisure, read our “Safety Tips” section in the app—it contains advice on how to protect yourself in online and offline communication.

We also recommend:

  • Not switching to third-party platforms (messengers, social networks) before both parties have passed photo verification.
  • Not making any private money transfers to other users.
  • In case of doubts—contact our support team.

11.5. D&D’s Responsibility

We make every effort to ensure safety within the service, including automatic and manual profile moderation, photo verification, and implementing abuse-detection systems.

However, we cannot guarantee:

  • that every user is who they claim to be;
  • that a user’s behavior will be flawless during real-life meetings;
  • that all intentions stated when creating a shared-leisure invitation will be fulfilled.

D&D is not liable for any loss, damage, or moral or physical harm caused by the actions or inaction of other service users.

11.6. Fraud and Community Protection

D&D takes safety and protection from fraudulent activities very seriously.

By fraud we mean any actions aimed at deceiving users in order to:

  • obtain money or gifts;
  • collect confidential information (e.g., banking details);
  • manipulate profile status, reviews, ratings, etc.;
  • forge or falsify identity, including fake photos or the use of artificial intelligence.

We apply automatic algorithms to detect suspicious activity. All fraud reports are promptly reviewed by moderators. If fraud is confirmed, the account is immediately blocked, and the person may be deprived of the right to re-register. We reserve the right to report serious violations to law enforcement.

If you suspect fraud, immediately notify us via the “Report” function in the user profile or through the “Support” section. Do not make any money transfers, even if a request looks plausible. Do not disclose private data (card numbers, passwords, access codes, etc.). If you suspect someone is using a fake name, photo, or information—submit a report for review.

D&D reserves the right to temporarily restrict profile features during an investigation; refuse to unblock an account upon discovery of fraudulent actions; restore compensation to a victim in the event of confirmed deception.

 

12. ACCOUNT DELETION

You have the right to delete your account in the D&D mobile application at any time. After account deletion, your profile will become unavailable to other users, and your personal data will be deleted in accordance with our Privacy Policy.

You can delete your account directly in the app settings under “Profile” → “Settings” → “Delete account.” After confirmation, your profile will be deactivated and will no longer be visible to other users.

Please note that after confirming deletion:

  • Your information will be completely removed from our servers within the period defined by our Privacy Policy;
  • You will lose access to all features and capabilities of the D&D app;
  • Any other internal rewards or metrics will be canceled without the possibility of recovery;
  • Account recovery after confirming deletion will be possible within 30 days. If more than 30 days have passed since account deletion, you will need to create a new account to use the service again.

Be aware that deleting the D&D mobile app from your device does not automatically delete your account or personal data. If you wish to completely delete your personal data and account, you must complete the steps described above in your profile settings.

If you have questions or difficulties deleting your account, you can contact our support via email or through the feedback form in the app.

After account deletion, the company may retain certain information in anonymized form for analytical or statistical purposes, in accordance with applicable law.

If you have an active shared leisure that has already been paid for, account deletion is only possible after completion or official cancellation of participation in that shared leisure through the app. If you attempt to delete your account before completion or confirmation, the shared leisure is automatically considered not to have taken place due to your fault, and financial sanctions may be applied in accordance with Section 8.

 

13. ACCOUNT BLOCKING AND DELETION

The D&D team values safety, comfort, and a positive app experience. Therefore, we reserve the right to take action to block or delete accounts if a user’s behavior violates these Terms and Conditions, the Privacy Policy, or applicable law.

13.1. Grounds for Blocking Accounts

We may temporarily or permanently block your account if one or more of the following violations are detected:

  • Complaints from other users about aggressive, unacceptable, or offensive behavior;
  • Dissemination of false information, creating a fake profile, using photos of other people, AI-generated or unreal images;
  • Fraudulent actions, attempts to deceive other users, or manipulating the system;
  • Failure to appear at shared leisure for which payment was received, without prior cancellation in accordance with Section 8;
  • Violations of ethics, bullying, aggression, hate speech, use of profanity, threats, discriminatory statements, propaganda of violence or hatred;
  • Sending unsolicited messages (spam), advertising, or commercial offers without prior approval;
  • Using bots or automated systems to interact with the platform;
  • Using the account for illegal activity;
  • Suspicions of hacking attempts, interference with the app’s operation, or intrusion into other users’ profiles;
  • Repeated or serious violation of D&D’s Terms and Conditions;
  • Offering, implying, or attempting to provide intimate, sexual, or escort services;
  • Posting prohibited content, in accordance with Section 10;
  • Abusing the “Report” function or defaming other users;
  • Behavior that discredits the platform or other accounts.

13.2. Blocking Procedure

If an account is blocked, the user will receive a notice about the fact and reasons for blocking via email or in the app.
The user has the right to appeal the blocking decision by sending a reasoned request to support at dateanddonate@proton.me or in the app section “Support and Help.” The decision on unblocking is made by the D&D app administration at its sole discretion after analyzing the provided explanations and information.

After blocking, the profile becomes unavailable to other users and is removed from the feed. You lose the ability to create or participate in shared leisure, view profiles, send messages.

If you sold participation in shared leisure and did not show up without explanation—your account is blocked until the circumstances are clarified. To unblock, you must pay a penalty of 20% of the shared-leisure price (see Section 8).

If the issue is not successfully clarified or there is no response, the account may be permanently deleted.
In some cases, the account can be restored after blocking by contacting support and passing additional verification.
If the blocking is related to payment violation/non-attendance, unblocking is possible after your request is reviewed.
We do not guarantee unblocking in every case, especially in cases of serious violations or attempts to bypass the system.

13.3. Grounds for Account Deletion

D&D reserves the right to permanently delete your account without the possibility of recovery if:

  • The user has independently requested account deletion;
  • Gross or systematic violations of the Terms and Conditions or applicable law have been detected;
  • Attempts to bypass blocking through new registration have been detected;
  • Providing false information about oneself has been confirmed;
  • A fake profile impersonating another person has been created;
  • Automated systems or bots have been used to interact with the app;
  • Actions have been taken that significantly harm the reputation or functionality of the D&D app, or in cases of a direct threat to the safety of other users.

In the event of account deletion, the user receives a deletion notice explaining the reasons for such a decision. All data and the user’s interaction history with the app are deleted from D&D systems within the timeframes defined by our Privacy Policy. A user whose account was deleted for gross violations loses the right to re-register in the app. If there is an account balance at the time of deletion, the account balance is not refunded.

13.4. Reporting Violations

If you witness violations by other users, please inform our support service using the “Report” function in the app or via email at support@datedonate.app. Every report will be carefully reviewed, and appropriate measures will be taken to protect our community.

D&D strives to create a safe, transparent, and comfortable environment for dating and urges all users to follow the rules and principles of mutual respect.
Reminder: D&D is not a service for escort, intimate services, or prostitution. Any attempts to use the platform for improper purposes are strictly prohibited. We are designed to organize participation in legal shared leisure with a social purpose, such as dating or communication.

13.5. Appealing a Blocking or Deletion Decision

If your account has been blocked or deleted and you disagree with this decision, you have the right to file an appeal within 14 calendar days from the date of blocking or deletion. To submit an appeal, send an email to dateanddonate@proton.me providing the following information:

  • Your app login.
  • The reason you believe the blocking/deletion is unfounded.
  • Any additional evidence or information that may help in reviewing your appeal.

Your appeal will be reviewed by the D&D administration within 7 business days. You will be informed of the results of the appeal review via email. We reserve the right to refuse account restoration if the rule violation was significant or if insufficient evidence was provided in your favor.

 

14. LIMITATION OF LIABILITY

We make every effort to make D&D a comfortable, safe, and effective platform for dating, meetings, and shared leisure. However, like any other mobile app, our service has certain limitations of liability. We want you to clearly understand the boundaries of our responsibility and your obligations when using the D&D service.

14.1. General Liability Provisions

D&D does not guarantee that you will find the perfect match or achieve desired results from using the app.
We cannot guarantee continuous, uninterrupted, or error-free operation of the app. Our service may be subject to technical work, updates, or unforeseen failures from time to time, which may temporarily limit access to the service.
We are not responsible for any losses, data loss, or other negative consequences caused by technical failures or temporary unavailability of the service.

14.2. Responsibility for User Interaction

D&D is a platform that facilitates organizing shared leisure for social purposes. We are not a party to your personal arrangements and are not responsible for the results of your shared leisure or interactions with other users.
We strictly prohibit the use of the app to organize any forms of escort, prostitution, intimate services, or procuring. You are solely responsible for compliance with these rules and the laws of your country of residence.
We are not responsible for any actions of users outside the app, including any events or consequences of shared leisure that occurred after using our platform.

14.3. Financial Responsibility

D&D is not responsible for your financial decisions or losses related to the use of the app.
You are solely responsible for any transactions made through the app, as well as for possible financial losses resulting from misunderstandings or conflicts with other users.
We do not guarantee refunds, except in cases explicitly provided for by our refund policy described in the relevant sections of these Terms.

14.4. Use of Content

D&D is not responsible for content uploaded by users. All information posted on the platform by other users is the responsibility of the individuals who posted it.
We reserve the right, but do not undertake the obligation, to review, modify, or delete content that violates these Terms or the law.

14.5. Links to External Resources

Our service may contain links to other websites or services. D&D is not responsible for the content, privacy policies, or activities of such third-party resources.

14.6. Limitation of Liability under the Law

By using D&D, you acknowledge that we do not provide any guarantees regarding the results of your dating or communication with other users. We do not guarantee a specific number of shared leisure activities, meetings, acquaintances, partners, or positive outcomes from using the service. The platform and all D&D information, materials, and services are provided “as is,” without any express or implied warranties (whether explicitly stated or implied) regarding satisfaction with the results of using the app.

To the maximum extent permitted by applicable law, D&D, its owners, employees, partners, service providers, or affiliates shall not be liable for any indirect, incidental, special, or punitive damages, including but not limited to loss of profits, data, or business reputation arising from the use of the app or the inability to use it.

14.7. Indemnification

You agree to hold harmless D&D, our partners, owners, and employees from any claims, demands, lawsuits, or damages, including legal costs, arising from your use of the app or your violation of these Terms or applicable law.

14.8. Changes to Liability Terms

We reserve the right to review or amend these liability provisions at any time. We will inform you of any changes via the app or by email.

14.10. Service Availability and Maintenance

D&D strives to ensure high availability and stability of the service for all users. However, the service is provided on an “as is” and “as available” basis, without any express or implied warranties.

We do not guarantee that the service will be available without interruption, errors, failures, or outages, including due to updates or maintenance, limitations from hosting providers, internet connectivity or payment systems, actions of third parties beyond our control (malicious actors, third-party services, etc.), or regulatory or legal restrictions in certain jurisdictions.

We reserve the right to temporarily limit or suspend access to the service, in whole or in part, for updates, maintenance, bug fixes, or the introduction of new features, which we may notify in advance via the app or email.

We are not responsible for any consequences arising from the temporary unavailability of the service, including loss of access to the profile, payments, or features during periods of limited availability. D&D also has no obligation to ensure permanent availability of the service and is not responsible for loss of functionality or income related to temporary unavailability of the service.

 

15. PRIVACY POLICY AND DATA USE

Your personal data and privacy are a priority for D&D. We understand the importance of protecting your personal data, so we strictly comply with all applicable legal requirements regarding privacy and personal data protection, as well as the policies and standards set by the Apple App Store and Google Play.

This section contains the basic principles of our Privacy Policy and explains how we collect, use, and protect the information we receive from you while using D&D. See our separate Privacy Policy for full information.

15.1. Information We Collect

To ensure the full operation of the service, we may collect the following information:

  • personal profile data (name, age, gender, location, height, preferences, photos, etc.) that you voluntarily provide during registration or when editing your profile;
  • photos and videos that you upload to the app when using the photo-verification feature or posting them in your profile;
  • shared-leisure and transaction data, including the history of shared leisure carried out, their details, the history of donations and payments;
  • technical and device data, including IP address, device type, operating system, app version, your device settings, cookies, and other similar technologies;
  • data about your interaction with the app, such as the history of profile views, interactions with other users, your messages, and activity within the service.

15.2. How We Use Your Data

D&D uses the collected information for the following purposes.
Ensuring the operation and administration of the app, including creating and managing your account, organizing shared leisure, payments, and donations.
Supporting and ensuring your safety, preventing fraud and other illegal actions.
Personalizing and improving your experience of using the platform.
Analyzing user activity to optimize and develop the service.
Sending important notifications, information about service updates, as well as marketing materials (with your consent).

15.3. Protection of Your Data

D&D applies modern technological and organizational measures to protect your personal data from loss, unauthorized access, use, disclosure, alteration, or destruction.
Your personal data is transmitted and stored using encryption and other modern security technologies.

15.4. Sharing Information with Third Parties

We do not sell your personal data to third parties.
We may share information with:

  • Service providers that help us deliver D&D services (e.g., payment services, analytics services, content moderation services, etc.).
  • Charitable funds to which you make donations through the platform.
  • In cases provided by law, including cooperation with law enforcement if necessary to investigate fraud or other violations.

D&D does not share personal data with third parties without the user’s consent, except in cases expressly provided by law or necessary to provide the service (e.g., payment processing or identity verification). We adhere to the principles of data minimization and proportionality in processing data.

15.5. Use of Cookies and Similar Technologies

We use cookies and similar technologies to improve the performance of our app, ensure security, personalize your experience, and analyze user behavior. For more details, see Section 10 of our Privacy Policy.

15.6. Your Rights and Managing Information

You have the right to access your information and the ability to update it in your profile.
You also have the right to request deletion of your account and related personal data (see the “Account Deletion” section for details).
You have the right to opt out of receiving marketing messages by changing settings in the app or via links in emails.

15.7. Additional Data Protection for U.S. Residents (Washington and Nevada)

If you are a resident of the states of Washington or Nevada, we provide additional guarantees and controls over your personal data, especially regarding sensitive information (e.g., health data). For details, see our full Privacy Policy.

15.8. Changes to the Privacy Policy

We may periodically update the Privacy Policy. You will be notified of any significant changes via the app, email, or in-app notifications. The updated version of the policy is always available for review in the app and on our website.

15.10. Managing Consent to the Processing of Personal Data

Providing consent
During registration, as well as when using specific features (e.g., photo verification, geolocation, analytics), you separately agree to the processing of the relevant categories of data. Consent is given by clicking the appropriate button, checkbox, or other active action (activating the feature).

Withdrawing consent
You may withdraw your consent to data processing at any time in your profile settings in the app or by sending a request to support at: dateanddonate@proton.me. After consent is withdrawn, some service features may become unavailable due to technical or legal requirements (for example, it is impossible to pass verification without a photo).

Viewing and editing data
You can view, update, or delete information from your profile at any time by going to “My Profile” → “Edit Profile” in the app.

Access to information
Upon request, you have the right to receive a copy of all personal data we store about you. To exercise this right, contact us by email at: dateanddonate@proton.me. We will respond within 30 calendar days in accordance with applicable data protection laws.

Request for restriction or deletion
You have the right to request restriction of processing or complete deletion of your personal data. Deleting data will result in deactivation or complete deletion of your account. Details are specified in the “Account Deletion” section.

Opting out of marketing messages
You can opt out of receiving marketing messages at any time. To do this, simply change the corresponding settings in your profile or use the “Unsubscribe” link in any of our emails.

 

16. COPYRIGHT INFRINGEMENT AND DMCA

We respect the intellectual property rights of others and expect our users to do the same. If you believe that any content in the D&D app infringes your copyright or other intellectual property rights, please send a notice of infringement to our support service. We promptly respond to all credible requests and take appropriate measures, including removing content or blocking access to it.

16.1. Infringement Notice

To submit a request to remove content that you believe infringes copyright under the U.S. Digital Millennium Copyright Act (DMCA) or other similar regulations, please provide us with the following information:

  • Identification of the copyrighted work claimed to have been infringed;
  • A link to or description of the material in D&D that allegedly infringes your right;
  • Your contact details (full name, address, email);
  • A statement that you have a good-faith belief that the use of the material is unauthorized;
  • A statement under penalty of perjury that the information provided is accurate and that you are the copyright owner or are authorized to act on behalf of the owner;
  • Your physical or electronic signature.

16.2. Counter-Notice (to contest removal)

If you believe that your content was removed by mistake or improperly, you may send a counter-notice. To do this, provide:

  • Your full name, address, email;
  • A description of the removed content and its prior location;
  • A statement that you believe the content was removed by mistake;
  • Your consent to the jurisdiction of the courts of Bulgaria (since the service is registered in Bulgaria);
  • Your signature.

We may restore the content if we receive a counter-notice that meets the requirements and if the copyright owner does not file a lawsuit within 10–14 days.

 

17. DISPUTE RESOLUTION

We want your experience with D&D to be pleasant, transparent, and safe. In the event of disputes or misunderstandings, we strive to help you resolve them effectively and fairly. This section explains how disputes are resolved between you and D&D, as well as between users of the platform. We formulate these terms according to the practices of popular dating apps and in accordance with the requirements of the Apple App Store and Google Play.

17.1. Resolving Disputes with Other Users

D&D is only responsible for the technical support and operation of the platform and does not control direct interactions between users. We encourage users to resolve disputes amicably and respectfully.
In the event of a dispute concerning shared leisure that did not occur or did not go as planned, the user who purchased participation in the shared leisure must report it via the corresponding button in the app or contact support.
Our support team will review your request within 48 hours and may propose the following resolution options:

  • refund or partial refund (in cases provided for by our terms);
  • rescheduling the shared leisure or agreeing on another form of compensation;
  • blocking or restricting the profile of the user who violated the terms.

17.2. Contacting Support

If you cannot resolve a dispute on your own, you can contact us via the built-in “Support” function in the app or send an email to: dateanddonate@proton.me
We strive to respond to your request as quickly as possible and will make every effort to resolve the issue in your best interest.

17.3. Resolving Disputes with D&D

If a dispute arises between you and D&D (Driveforce Ltd), we recommend first trying to resolve it through direct negotiations. Contact our support team and describe the issue in detail.
If negotiations do not lead to an agreement, the dispute may be resolved through arbitration under the applicable laws of Bulgaria, since Driveforce Ltd is registered in Bulgaria. Place of arbitration: Burgas, Bulgaria. Governing law: Applicable laws of Bulgaria.
You agree that all disputes are considered individually. Class or group claims regarding the use of D&D are prohibited.
All disputes arising in connection with the use of the service are resolved through mandatory arbitration in accordance with applicable law. The user has the right to opt out of arbitration by sending a written notice within 30 days from the date of acceptance of these Terms.

17.4. Time Limits for Filing Claims

Any claims or demands arising in connection with the use of the D&D service must be filed within 6 (six) months from the date the grounds for such claims arose. Claims filed after this period will not be considered.

17.5. Waiver of Court Proceedings

By using the D&D service, you voluntarily waive the right to a jury trial and agree to resolve disputes through arbitration as specified above.

 

18. INTELLECTUAL PROPERTY

All elements and materials of the D&D mobile app (including, but not limited to, texts, images, logos, video, audio, interface design, database structure, algorithms, gamification elements, virtual gifts, internal currency, as well as descriptions of functionality) are intellectual property objects and are protected under the applicable laws of Ukraine, the legislation of the European Union, international copyright law, and international treaties to which Bulgaria, the EU, and Ukraine are parties.
All rights to these materials belong to Driveforce Ltd or have been lawfully transferred to the platform based on license agreements.
Any copying, modification, reproduction, distribution, publication, or other use of the platform’s materials without prior written consent from Driveforce Ltd is prohibited. This applies to both automated (e.g., using bots, scrapers, APIs without permission) and manual copying of any content.
Using platform elements for commercial purposes, including partially, without prior approval, is considered an infringement of intellectual property rights and may be subject to legal action.
In the event of copyright or related rights infringement, the D&D administration reserves the right to immediately restrict access to the violator’s account, block content, and take action in accordance with applicable law.
Content uploaded by the user (photos, descriptions, etc.) remains their property; however, from the moment of upload, the user grants D&D a non-exclusive, royalty-free, worldwide license to use this content within the app’s functionality and to promote the service, in accordance with the “User Content” section.

 

19. CHANGES TO THE TERMS

We continuously develop and improve D&D to make it as convenient, useful, and safe as possible for you. Therefore, we may occasionally update, change, or supplement these Terms and Conditions to comply with applicable law, the recommendations of the Apple App Store and Google Play, as well as our own policies and procedures. This section explains how we inform you about changes and what happens after they are published.

19.1. Notification of Changes

We undertake to clearly inform users about any significant changes to the Terms that may affect your rights, obligations, or experience using the app. Notification may be carried out in the following ways:

  • Via push notifications or in-app notifications.
  • By email, if you have provided your email address in your profile.
  • By posting information about changes directly in the app or on our official website.

We strongly recommend regularly reviewing these Terms to stay aware of potential changes.

19.2. How Changes Take Effect

Changes to the Terms and Conditions take effect from the moment they are published in the app or on the D&D website, unless otherwise specified in the relevant notification or in the document itself. If you continue to use our service after the changes take effect, it means that you accept the updated Terms and Conditions in full.
If you do not agree with any changes, you must stop using the service and may delete your account according to the procedure described in the “Account Deletion” section or contact our support to receive assistance with deactivating your profile.

19.3. Your Actions if You Disagree with the Changes

If you disagree with the updated Terms, you may stop using the D&D service or delete your account at any time (instructions are in Section 12, “Account Deletion”).
Important: if you continue to use the app after the changes take effect, we will consider that you have accepted these changes.

19.4. Minor and Material Changes

Minor changes: may include correction of typos, clarification of terminology, or other non-material edits that do not affect your rights or obligations. Such changes take effect immediately upon publication, and a separate notice may not be sent.

Material changes: may affect your rights and obligations, the terms of using the service, or the privacy policy. Material changes include, among others, changes related to payment or subscriptions, changes to the privacy or data use policy, new restrictions or conditions for using the service, and changes that affect the ability to access your profile or the service in general.
A notice of such changes is sent via push notifications in the mobile app or by email (if the address was specified in the profile), or via an in-app message (banner or pop-up) and by publishing the updated version of the Terms on our website and in the app.
In the event of material changes to this Privacy Policy, we will notify you before such changes take effect, providing you with the opportunity to familiarize yourself with the updates and, if necessary, stop using the service.

19.5. Frequency of Reviewing the Terms

We recommend checking this page regularly (at least once a month) to stay informed about the current terms of using the app and possible updates.
